Provisions Of The Limited Warranty The limited warranty is between the vehicle owner, as stated, and C.A.R.S. Coverage begins on the day this application is received with payment and approved by C.A.R.S., and will last for the time period indicated. Total cumulative benefits under the limited warranty will not exceed the NADA Clean Loan value at time of claim authorization. We reserve the right to reject or cancel any application or limited warranty for cause as determined by C.A.R.S. If you do not understand the terms of the limited warranty, contact C.A.R.S. for clarification.

An inoperative odometer shall void the limited warranty. Altered or modified vehicles are not covered and shall also void the limited warranty. The vehicle owner is responsible for properly maintaining the vehicle in accordance with manufacturer’s specifications and to protect against further damage caused by continued operation or damage from overheating.

C.A.R.S. will oversee the repair or replacement of any covered component that is found to be defective beyond manufacturer’s specifications, including failures resulting from normal wear and tear. The failure must occur, and the claim must be opened while the limited warranty is in effect. C.A.R.S. will arrange for payment of the amount of the authorized repair, less related charges not covered by the limited warranty, less a one hundred ($100.00) dollar deductible per claim.

Warranty Claim Procedure: Your vehicle must be at a qualified repair facility, within the continental United States, in order for a claim to be opened, and the vehicle must remain at the repair facility until repairs are complete. The repair facility must call C.A.R.S. at 888-335-6838 to open a claim. At the discretion of C.A.R.S., a proper diagnosis shall include tear-down to the point of component failure, performed by the repair facility, to determine the cause of failure and the extent of damage. You are responsible for all charges relating to the tear-down and diagnosis of the vehicle. If C.A.R.S. inspects the vehicle and it is not disassembled to allow verification of the cause and extent of the failure, you will be responsible for all re-inspection costs. The repair facility must provide C.A.R.S. with an estimate before any repairs are begun. If it is determined that a covered component has failed and an estimate for the repairs is approved by C.A.R.S., an authorization number will be issued for the repair. The authorization number must appear on all invoices and receipts submitted for payment and is valid for 180 days from the date issued; after which time the authorization number and claim is void. No invoices or receipts will be processed without a valid authorization number.

Repairs can be done at any qualified repair facility. C.A.R.S. reserves the right to have the repairs performed at a location other than the one you selected. C.A.R.S. has the right to select and supply used, rebuilt or aftermarket components when authorizing repairs. You must retain all vehicle maintenance/repair records for review at the request of C.A.R.S.

Additional Terms: The limited warranty is transferable to subsequent owners of the vehicle, provided C.A.R.S. receives the transfer fee of ninety-nine ($99.00) dollars prior to the vehicle being transferred. The transferred limited warranty will remain in effect for the remainder of the original period. Without the prepayment of the transfer fee, the limited warranty cannot be assigned and will be void at the time the vehicle is transferred. The new customer is responsible for all maintenance records from the time the warranty was originally received and approved. The new customer will not be eligible for a refund.

C.A.R.S. will not be responsible for any time lost, any inconvenience caused by the loss of your vehicle, the quality of the repair by the repair facility for any other incidental or consequential damages you may have.

The limited warranty contains the complete agreement between C.A.R.S. and the vehicle owner. C.A.R.S. does not allow any third party to create any obligation or liability in connection with the limited warranty. No third party has any rights under the limited warranty. The selling dealer is not an agent of C.A.R.S. The limited warranty gives the limited warranty holder specific rights that may vary from state to state and he/she may also have other rights. This limited warranty application, if accepted by C.A.R.S., shall be interpreted and subject to the laws of the state where the sale of the vehicle took place regardless of where a claim or mechanical failure occurs.

Cancellation Provisions: There is no credit for early termination except if the vehicle is declared a total loss by the carrier insuring the vehicle or if the vehicle is repossessed by the lien holder. C.A.R.S. shall refund to the dealer or lien holder a portion of the amount received by C.A.R.S. for your contract on a monthly prorated basis, less a service charge of forty ($40.00) dollars, as long as no claims have been made against the vehicle. If a vehicle is altered or modified after purchase and if a claim has been made or paid, the warranty is cancelled and no refund shall be issued.
